Failure to Get Medical Treatment

One of the worst mistakes that you can make is to delay medical treatment. Oftentimes, because of the shock and adrenaline at the scene, a person does not feel their injuries right away. However, usually later that day or the next day, the injuries set in. Once this happens, you need to see a doctor of your choice.

Why Is Medical Treatment So Important After A Car Accident?

Medical treatment is critical because the medical records are what will be used to prove that you were in fact hurt. Without proper documentation from medical professionals, you should assume that no insurance company will pay you anything for your injuries. The longer that you wait to see a doctor causes an additional problem, in that it raises doubt that your accident is the actual cause of your injuries. When you want too long to seek medical treatment, the insurance company will use this as an excuse to deny your claim altogether or greatly reduce the value. In Florida, the minimum amount of insurance coverage that is required by law is $10,000 in Personal Injury Protection (PIP) and $10,000 in Property Damage Liability coverage. Because Florida is an “At-Fault State,” your PIP coverage will pay up to 80% of your medical bills (you may also have a deductible).

How Long After My Accident Do I Have To Seek Medical Treatment?

In Florida, a person who is injured in a motor vehicle collision has 14 days to seek medical treatment or they will not be entitled to their PIP benefits. Even if you have not sought treatment within the 14 days, you may still have a case but keep in mind, your delay has made it much more difficult to prove your injuries, and less likely that an attorney will take your case. It is true that some injuries take longer to set it in. Do not ignore what seems to be minor pain. At the very least, go see a doctor who can use his expertise and training to rule out the severity of your injuries.
